(WEST PARRY SOUND, ON) – The West Parry Sound Ontario Provincial Police (OPP) encountered two drivers that should not be operating a motor vehicle on a highway. Whether it is a suspended driver due to a Provincial Offence or a Criminal Code Offence, these drivers have a lot at stake.
The driver could face an immediate impoundment of the vehicle used in the offence. The cost to recover the vehicle from the impound facility rests with the vehicle’s owner.
Motorists caught driving while suspended under a Provincial Offences Act could face a fine of $1,000 to $5,000 for a first offence and $2,000 to $5,000 for a subsequent offence. If the suspension is from a Criminal Code Conviction, the fine is between $5,000 to $25,000 for a first offence and $10,000 to $50,000 for a subsequent offence within five years. The judge could also impose up to 6 months in jail as well as an additional driver’s licence suspension for both Provincial and Criminal suspensions.
In addition, it will cost the driver $150 to have their driver’s licence reinstated by the Ministry of Transportation of Ontario (MTO) once the suspension is over. If the licence has been suspended for longer than one year, the driver may have to take certain tests, such as an eye test, a written knowledge test and/or a road test.
On February 21, 2014 Penny RAY, 43 years of age from Georgian Bay Township, was charged with Drive While Under Suspension and Drive Over the Posted Speed Limit, contrary to the Highway Traffic Act. The accused will appear before the Provincial Offences Court Parry Sound on April 29, 2014 to answer to her charges.
On February 24, 2014 John DONALD, 72 years of age from Seguin Township, was charged with Driving While Disqualified – Court Order, contrary to the Criminal Code of Canada. The vehicle he was driving on the date of the offence was impounded for 45 days. The accused will appear before the Ontario Court of Justice Parry Sound on March 20, 2014 to answer to his charge.
