(Hawkesbury, ON) In the early morning of Monday April 21st, 2014, shortly before 3am, Constable Anne Christine Gauthier stopped a 2008 Nissan Altima on John Street in Hawkesbury during a RIDE initiative.
Interaction with the driver gave the officer reason to believe that she had consumed alcohol. The driver was asked to provide a breath sample to determine if she had blood alcohol content under the legal limit. The driver refused. The driver was consequently arrested for refusing to provide a breath sample.
Illicit drugs were found in her possession during the arrest. Liquor was found in the vehicle, readily accessible to the driver. She had a G1 driver’s licence and was subsequently found contravening conditions of the licence.
Marie-Pier BERNIER (23 yrs) of Hawkesbury, was charged under the Criminal Code of Canada with section CC 254(2) Fail or Refuse to Provide Breath Sample.
The driver was issued 3 Highway Traffic Act provincial offences notices for the following:
HTA section 5(1) Class g1 licence holder-Drive at unlawful hour
HTA section 33(1) O.Reg 340/94 -Fail to notify change of address
Liquor Licence Act – Section 32(1) – Driving motor vehicle with liquor
readily available.
She was also charged under the Controlled Drugs and Substances Act with the following sections :
– 4(1) Possession of a Schedule I Substance – Methamphetamine (2 counts)
– 4(1) Possession of a Schedule II substance- Cannabis Marihuana – under
30grams
She was later released on a promise to appear in court on May 17th, 2014 in L’Orignal.
