(TOWNSHIP OF CHATSWORTH, ON) – On Saturday, July 18, 2015 at approximately 11:55 p.m., Grey County Ontario Provincial Police (OPP) stopped to check on the occupant(s) of a 2015 Chevrolet Camaro which was stopped with its hazard lights activated on Hwy. 6 &10 at Boundary Road, in the Township of Chatsworth. Upon approaching the vehicle, the officer observed a male, who, after relieving himself, took a drink from a plastic cup which was resting on top of the trunk.
The male, who was identified as the driver of the vehicle, had been drinking alcohol. Investigation revealed that he held a G2 driver’s licence and was suspended from driving.
The officer issued a demand to provide a sample of his breath into an Approved Screening Device, which he refused. Despite the officer’s warnings as to the consequences of refusing the breath demand, both the driver and a female passenger continued to be verbally confrontational with police.
27-year old, Alix MATTHEW, of Barrie, Ontario was charged with refusing to comply with a demand made to him by a peace officer under subsection 254(2) of the Criminal Code, to provide forthwith, such sample of his breath, as in the opinion of the police officer is necessary to enable a proper analysis of his breath to be made by means of an approved screening device and to accompany the peace officer for the purpose of enabling such a sample of his breath to be taken, contrary to Section 254(5) of the Criminal Code.
The vehicle was impounded.
He is scheduled to appear in court in Owen Sound on Thursday, August 20, 2015.
