(HEARST, ON) – On April 13, 2016, at approximately 12:00 p.m., the James Bay Ontario Provincial Police (OPP) was advised of a motor vehicle collision in the area of Front and 3rd Street in the Town of Hearst.
Police investigation revealed that a pick-up truck carrying an insecure Motorized Snow Vehicle (MSV) went into the ditch. During the investigation, Hearst officers with the assistance of an OPP Drug Recognition Evaluator (DRE) determined that the male driver was impaired by drug and he was arrested.
Stephane ROBITAILLE, 36, of Hearst, Ontario was charged with the following offences:
Driving While Ability Impaired – motor vehicle contrary to section 253(1)(a) of the Criminal Code of Canada (CC)
Possession of a Schedule I Substance – (opioids) contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA)
Fail to Comply with Conditions of Undertaking Given by Officer in Charge contrary to section 145(5.1) (CC)
Possession of Unmarked Cigarettes contrary to section 29(2) of the Tobacco Tax Act of Ontario (TTA)
Careless Driving contrary to section 130 of the Highway Traffic Act of Ontario (HTA)
Fail to Report Accident contrary to section 199(1) (HTA)
Insecure Load contrary to section 111(2) (HTA)
The accused was released and is scheduled to appear at the Ontario Court of Justice in Hearst on May 18, 2016.
