Mother And Son Charged After Impaired Investigation

(ELLIOT LAKE, ON) – On December 25, 2016 at 1:15 p.m., the East Algoma Ontario Provincial Police (OPP) members received a call of an impaired driver operating a motor vehicle on Stanrock Road, in the City of Elliot Lake.

OPP officers later located the vehicle on Stanrock Road and recognized the male driver to be driving. Police turned around and conducted a traffic stop, but now the female passenger was sitting in the driver’s seat.

Steven Chad PAYNE, 39 years of age, from Elliot Lake, was charged with:

Fail or Refuse to Provide Sample, contrary to section 254(2) of the Criminal Code (CC)

Dangerous Operation of Motor Vehicle, contrary to section 249(1)(a) of the CC

Obstruct Peace Officer, contrary to section 129(a) of the CC

Uttering Threats – Cause death or Bodily Harm, contrary to section 264.1(1)(a) of the CC

Fail to Comply with Recognizance, contrary to section 145(3) of the CC

Betty PAYNE, 62 years of age, from Elliot Lake, was charged with:

Obstruct Peace Officer, contrary to section 129(a) of the CC

The accused persons are scheduled to appear before the Ontario Court of Justice in Elliot Lake on February 7, 2017.
