(OXFORD COUNTY, ON.) – Members from The Ontario Provincial Police (OPP) Highway Safety Division received a complaint of an erratic driver westbound on Highway 401 in Oxford County, shortly before 10:00 a.m. on October 8, 2014.
A traffic stop was conducted on the suspect vehicle, a Volkswagen Jetta, on Highway 401 near Elgin Road in Middlesex County. The male driver verbally identified himself to police and an investigation commenced. The driver was issued a three day drivers licence suspension for registering a warning on an approved roadside screening device. The vehicle was towed off the highway and the driver was instructed to await a licenced driver to retrieve it.
At approximately 1:30 p.m. the same vehicle was reported again driving erratic, this time eastbound on the 401 Highway in Oxford County. OPP located the vehicle and observed the driver operating the vehicle on the paved portion of the shoulder. A traffic stop was conducted. Further investigation revealed that the driver falsely identified himself in the earlier traffic stop and was arrested. The vehicle was impounded for seven days.
Nicholau BARBOSA, 36 years old of Brampton is charged with the following:
Obstruct Peace Officer – contrary to the Criminal Code of Canada
Personation with Intent to avoid Arrest, Prosecution or Obstruct Justice (Identity Fraud) – contrary to the Criminal Code of Canada
Driving while under Suspension (2 counts) – contrary to the Highway Traffic Act (H.T.A.)
Class G1 Licence holder – drive on prohibited highway (2 counts) – contrary to H.T.A.
Class G1 Licence holder – B.A.C. above zero (2 counts) – contrary to H.T.A.
Class G1 Licence holder – unaccompanied by qualified driver (2 counts)- contrary to H.T.A.
Driver – fail to surrender Licence – contrary to H.T.A.
Careless Driving – contrary to H.T.A.
BARBOSA’S was released on a Promise to Appear with a future court date.
