(HUNTSVILLE, ON) – On Wednesday April 27, 2016 at approximately 8:20 p.m. the Almaguin Highlands Ontario Provincial Police (OPP) was conducting a joint initiative with the Ministry of Transportation (MTO) at the Highway 11 inspection station south of Novar, Ontario.
Officers were assisting the MTO with commercial motor vehicle inspections when a vehicle entered the inspection station looking for directions. The officer suspected the driver had been drinking alcohol when the suspect drove off south bound on Highway 11. OPP attempted to stop the driver, but he exited at the Waseosa Lake Road and failed to stop at a stop sign, rolling the vehicle into the ditch. The driver of the vehicle was not injured, but the officer arrested him for impaired operation.
Officers charged James LIVINGSTON, 34 of Etobicoke Ontario with the following offences:
• Driving while ability impaired – motor vehicle, contrary to section 253(1)(a) of the Criminal Code (CC)
• Driving with more than 80 milligrams of alcohol in blood, contrary to section 253(1)(b) of the CC
• Flight while pursued by police officer, contrary to section 249.1(1) of the CC
• Drive motor vehicle with open container of liquor, contrary to section 32(1) of the Liquor Licence Act (LLA)
• Disobey stop sign, contrary to section 136(1)(a) of the Highway Traffic Act (HTA)
The accused was released from police custody and is to appear at the Ontario Court of Justice on Wednesday June 15, 2016 in Huntsville, Ontario.
