(CHATHAM, ON) On December 14, 2016, around 9:30 p.m., Chatham-Kent Ontario Provincial Police (OPP) responded to a motor vehicle collision on Highway 401 near Kent Bridge Road. A tow truck was setting up to remove a vehicle, from the centre median, when a transport truck collided with the tow truck.
While speaking with the driver of the transport truck, the officer determined the driver had consumed alcohol. The driver was transported to detachment for breath tests.
Upon further investigation, the male driver, Rubin HARTWICH, 49-years-old of Ste Anne, Manitoba, was charged with drive while ability impaired, and drive motor vehicle with more than 80 milligrams of alcohol in blood contrary to the Criminal Code of Canada.
He was also charged under the Highway Traffic Act (HTA) with: fail to move into another lane for emergency vehicle or tow truck – if safe to do so and drive motor vehicle with open container of alcohol.
The accused is required to appear before the Ontario Court of Justice on January 13, 2017 to answer to the charges.
