John FOGARTY – Drunk Driving

(ESPANOLA, ON)- On September 27, 2016, members of the Espanola Ontario Provincial Police (OPP) established a R.I.D.E. (Reduce Impaired Drivers Everywhere) initiative on Lee Valley road, in the Township of Sables-Spanish Rivers.

At approximately 5:35 pm, officers had occasion to check a vehicle occupied by a male who stopped at the R.I.D.E. program. Investigation revealed that the driver had been drinking.

The driver, John FOGARTY, 56 years of age from Espanola, was arrested and charged with:

Driving with more than 80 milligrams of alcohol in blood, contrary to section 253(1)(b) of the Criminal Code

Drive motor vehicle with open container of liquor, contrary to section 32(1) of the Liquor Licence Act

The accused driver’s licence has been suspended for 90 days and the vehicle he was operating was impounded for seven (7) days.

The accused will appear before the Ontario Court of Justice in Espanola, on October 17, 2016, to answer to his charges.

The OPP is reminding motorists that there is no safe amount of alcohol or drug consumption when driving. Anyone who suspects a driver is driving while impaired is urged to call police by dialing 9-1-1 immediately.
