Impaired Driver Charged – Passenger Gets Drug Charge

(WEST PARRY SOUND, ON) – On March 17, 2016, a member of the West Parry Sound Ontario Provincial Police (OPP) was conducting radar enforcement on Highway 124 in McDougall Township. At approximately 2:05 a.m. police conducted a traffic stop on a vehicle travelling at a slow rate of speed. The officer determined the driver had consumed alcohol.

As a result of the officer’s investigation, Brennan GALLO, 27 years of age from Hamilton, was arrested and charged with the following:

Driving while ability impaired – motor vehicle contrary to the Criminal Code (CC).

Fail or refusal to provide breath sample contrary to the CC.

Possession of a Schedule II Substance – Cannabis Marihuana – under 30 grams as per the Controlled Drugs and Substances Act (CDSA).

Possession of a schedule II substance – Cannabis Resin – over 1 gram as per the CDSA.

Driving motor vehicle with open container of liquor contrary to the Liquor Licence Act (LLA).

Novice driver – B.A.C. above zero contrary to the Highway Traffic Act (HTA).

The passenger, Brian L’HOMME, 27 years of age from Hamilton was arrested and charged with the following:

Possession of a Schedule II Substance – Cannabis Marihuana – under 30 grams as per the CDSA.

Possession of a schedule II substance – Cannabis Resin – over 1 gram as per the CDSA.

Possess unmarked cigarettes contrary to the Tobacco Tax Act (TTA).

Having liquor in an open container other than in licenced premises, residence or private place contrary to the LLA.

The accused will appear before the Ontario Court of Justice in Parry Sound on March 31, 2016 to answer to their charges. The driver‘s licence was suspended for 90 days and the vehicle was impounded for seven days.
