(Newburgh, ON)- On Saturday April 4, 2015 at 4:45 p.m. officers with the Napanee detachment of the Ontario Provincial Police conducted a RIDE program in the village of Newburgh, Township of Stone Mills.
An officer noticed a red ATV exiting the Cataraqui Trail. All-terrain vehicles are prohibited from being on the Cataraqui Trail and signs are posted to indicate that.
Police spoke with the ATV driver and noted a small cooler on the footrest of the ATV. The officer seized alcohol from the cooler and gave the driver an alcohol roadside screening test. The driver was subsequently arrested for operating a motor vehicle with over 80 mgs of alcohol in his system.
As a result of the investigation 51 year-old Tony GODFREY of Stone Mills Township faces the following charges:
· Operating a motor vehicle with over 80 mgs of alcohol in 100 ml of blood contrary to section 253(b) Criminal Code
· Engage in prohibited activity on premises contrary to the Trespass to Property Act section 2(1)(a)(ii)
· Drive motor vehicle with open container of liquor contrary to section 32(1) of the Liquor Licence Act
· Drive while under suspension contrary to the Highway Traffic Act section 53(1)
Mr. GODFREY is scheduled to appear in Provincial Court in Napanee on April 28, 2015.
The Napanee OPP would like to remind residents that All Terrain Vehicles are not permitted to be used on the Cataraqui Trail.
