On December 3rd, 2015 at approximately 10:00am, officers from the Peterborough County OPP Detachment were dispatched to a home invasion report at an apartment in the Village of Havelock. A lone male attended the building and kicked in the front door of the apartment looking for one of the tenants. The tenant was not home at the time so the suspect departed the building to an awaiting vehicle parked nearby. The lone male was confronted outside the awaiting vehicle by witnesses to the crime. In the process of leaving, he assaulted one of the witnesses as well as an occupant of the awaiting vehicle. One of the victims assaulted was transported to Campbellford Hospital with non life threatening injuries.
As a result of a subsequent investigation, the lone suspect was located at a residence in the Village of Warkworth and arrested without incident.
Charged is: Toby Fox, 31 years of age of Warkworth,Ontario.
Mr. Fox is charged with the following offences:
1) Break & Enter contrary to Section 348(1)(a) of the Criminal Code of Canada
2) Assault with a Weapon contrary to Section 267(a) of the Criminal Code of Canada
3) Dangerous Driving contrary to Section 249(1)(a) of the Criminal Code of Canada
4) Drive Disqualified contrary to Section 259(4) of the Criminal Code of Canada
5)Assault contrary to Section 266 of the Criminal Code of Canada
Toby Fox will be held for a bail hearing scheduled for December 4th, 2015 at the Peterborough Provincial Court.
