(MUNICIPALITY OF NORTH PERTH, ON) – On Tuesday August 04, 2015, around 11 a.m., Perth County Ontario Provincial Police (OPP) officers were dispatched to a collision at Victoria Ave South in Listowel near a private driveway south of Elma St. West.
Investigation revealed that a bicyclist had ridden his bicycle from a private driveway and entered onto Victoria Ave South where it collided with a North bound Chevy Silverado pickup truck. The impact caused the bicyclist to fall and sustain minor injuries.
The 76 year old driver of the pickup truck was uninjured and there was no damage to the pickup truck.
The 38-year-old bicyclist Keith ZOET of Moorefield has been charged with “fail to yield from driveway”, contrary to the Highway Traffic Act of Ontario.
Bicyclists need to realize that they have the same rights and responsibilities to obey all traffic laws as other road users. They must yield the right-of-way to pedestrians and vehicles already in intersections or approaching the intersection so closely that it would be hazardous for them to proceed. When entering onto a through roadway from a private driveway, they shall yield the right-of-way to traffic that is travelling on the roadway.
