(MIDDLESEX CENTRE, ON) – On November 2, 2017, at approximately 12:30 p.m., a member of the Middlesex County Ontario Provincial Police (OPP) was on general patrol on Elginfield Road, Municipality of Middlesex Centre.
The officer spotted a Ford Mustang speeding on Elginfield Road and initiated an investigation for speeding.
Officers determined that the 20-year-old male driver of the vehicle had consumed alcohol. He was placed under arrest and transported to a Middlesex County OPP detachment for breath tests. Once at detachment, the male refused to provide a breath sample as required by law.
As a result of the police investigation, Benjamin AUER, of St. Marys, has been charged with Refusing to Provide a Breath Sample pursuant to the Criminal Code of Canada (CCC), as well as Speeding, Young Driver BAC Above 0 and Driving with Liquor readily available pursuant to the Highway Traffic Act (HTA) and the Liquor Licence Act (LLA).
The accused’s vehicle has been seized for 7 days and drivers licence suspended for 90 days.
The accused was released on a Promise to Appear (PTA) and is scheduled to answer the charges in a London court on December 4, 2017.
