(WEST PARRY SOUND, ON) – On January 31, 2015, members of the West Parry Sound Ontario Provincial Police (OPP) were patrolling in the Town of Parry Sound. At approximately 10:48 p.m. a Motorized Snow Vehicle (MSV) failed to stop for police and was followed to a residence in Parry Sound.
As a result of the officer’s investigation the driver was arrested. Richard Bailey, 43 years of age, from Parry Sound was charged with the following:
1. Driving while ability impaired – motor vehicle (Alcohol) contrary to the Criminal Code (CC).
2. Driving with more than 80 mgs of alcohol contrary to the CC.
3. Dangerous operation of motor vehicle contrary to the CC.
4. Flight while pursued by Peace Officer contrary to the CC.
5. Resist Peace Officer contrary to the CC.
6. Possession of a Schedule II Substance – under 30 grams as per the Controlled Drug and Substance Act (CDSA).
7. Drive – no insurance contrary to the Motorized Snow Vehicle Act (MSVA).
8. Fail to notify change of ownership contrary to the MSVA.
9. Drive motorized snow vehicle while licence suspended contrary to the MSVA.
10. Fail to display evidence of permit contrary to the MSVA.
The accused will appear before the Ontario Court of Justice in Parry Sound on March 5, 2015 to answer to his charges.
Along with these charges, the MSV was impounded for 7 days. If convicted of snowmobiling while impaired, a rider could lose all driving privileges (car, truck, motorcycle, boat, off-road vehicles and snowmobiles).
