(Ashfield Colborne Wawanosh, ON) On September 26, 2009 at approximately 11:00 pm Huron OPP officers were called to a Glen’s Hill Road address to a report of a trespassing man on an ATV riding around a residence doing donuts and chasing the family dog. The complainant indicated that the driver appeared to be impaired.
At approximately 11:30 pm officers arrived on scene and found an unplated ATV stopped but running with a male sitting on top of it. Upon making contact with the man, the officer determined that he was impaired by alcohol. The man resisted the officers’ attempts to get him to dismount the vehicle.
The man was arrested and taken to the Huron Detachment where he met with a qualified Intoxilizer Technician to provide samples of his breath. The man refused to provide two suitable samples of his breath as required by law.
As a result of the investigation, Terry Austin (26) of Goderich has been charged with Impaired Driving, Dangerous Operation, Drive While Disqualified, Fail to Provide Breath Sample and Resist Arrest. He will answer to his charges on November 9, 2009 in Goderich Court.
The ATV was towed and will be impounded for 45 days as per statute. Mr.Austin’s licence was also suspended for a period of 90 days.
