St.Marys Man Facing Over 80 Charge

(ST.MARYS, ON) – A 29-year- old male driver is facing a charge of “care or control over 80 mgs.” contrary to the Criminal Code of Canada, after he was found parked at an intersection in St.Marys on Saturday December 05, 2015, around 11 p.m.

Perth County Ontario Provincial Police (OPP) officers on general patrol observed a Buick Lacrosse at the intersection of Egan Ave and James St North where it was a hazard to traffic. The vehicle’s engine was running and there were four occupants inside. While speaking to the male occupying the driver’s seat the odour of an alcoholic beverage was detected on his breath.

A roadside screening test was administered which the driver failed. He was arrested and transported to the Perth County OPP Detachment in Sebringville for breath tests. He provided two breath samples to a qualified Intoxilyzer Technician and both samples registered over the legal limit.

As a result, 29-year-old Ryan Ferris STEWART of St.Marys has been charged with “care or control over 80 mgs”. He has a court appearance scheduled for the Ontario Court of Justice – Stratford on December 21, 2015. He also received an automatic 90 day driver’s licence suspension and his motor vehicle was impounded for seven days.
