Type: Possible Impaired Driver
Location: Third Ave and Nelson Streets
Incident: On Wednesday March 2, 2016 at approximately 8:37 p.ma 20 yr old Brantford male was found passed out behind the wheel in the driver’s seat position of his vehicle with the ignition still running, at the corner of Third Avenue and Nelson Street in the City of Brantford.
After numerous attempts to wake the accused, he stirred, at which time Police detected an odour of an alcoholic beverage on his breath. Two open alcoholic beverage containers were observed in plain view in the front cup holders. The male was arrested and brought to the station for a breath test. Due to the low alcohol reading in his system, it appears that the male just couldn’t handle the drinks he had consumed before passing out behind the wheel. Because the man was under 22 yrs old and was a class G2 licenced driver, he was to have zero concentration of alcohol in his system. He was charged with that liquor prohibition offence and with having open alcohol in his vehicle accessible to the driver. He was released with a court date in April 2016.
The Police would like to remind the public that Liquor being transported inside the vehicle must have the original seal unbroken. A partially consumed then recapped beer is still open liquor. Regardless of who has the open liquor, the driver can be charged. Further, the HTA requires that all drivers age 21 and under, regardless of licence class, must have zero blood alcohol when operating a motor vehicle. – Insp Wiedrick
