The Ontario Provincial Police would like to inform motorists of section 73(3) Colour coating obscuring interior.
“No person shall drive on a highway a motor vehicle on which the surface of the windshield or of any window to the direct left or right of the driver’s seat has been coated with any coloured spray or other coloured or reflective material that substantially obscures the interior or the motor vehicle when viewed from outside the motor vehicle.”
This section was introduced in the early 1990’s for the primary reason of officer’s safety. “Traffic stops” are known to be high risk and statistics show where many officers have been injured when dealing with highway violators.
The OPP have a mandate to keep our roads safe. Traffic initiatives such as Seat Belt and Distractive Driving campaigns are one of few traffic projects officers have to deal with. Violators using tinted windows prevent road officers to do an effective job.
Vehicle owners must be cautious when attending shops to have their windows tinted. At this time, if an OPP officer has any difficulty seeing a silhouette behind the wheel or issues in determine the gender of the driver, the driver will run the risk of being charged. The OPP officer doesn’t require any measuring device to warrant an offence notice.
