Not Returning Turban Is A Violation Of Rights – Drunk Driving Case Thrown Out

Brampton – In a recent court decision, charges of Impaired Driving and Excess Blood Alcohol were dismissed against a Sikh man because officers did not return his turban to him after it had accidently fallen off his head while he was being placed in the cruiser following his arrest.

Upon learning of this incident, Chief Evans ordered a review of the decision and the officer’s actions. Peel Regional Police have had a directive in place since 2012 regarding the proper search and handling of religious items recognizing that they are of great importance in keeping with the freedom of religious rights.

“I am concerned by the negative impact that this incident and my officer’s actions have had on members within our community. The purpose of police directives is to set out these responsibilities expected of the officers. We have since reinforced the importance of this directive to ensure that this type of mistake does not occur in the future.”

Peel Regional Police are committed to serving our community in a fair and respectful manner ensuring the safety and security of all. A training bulletin was issued internally to remind all officers of this and other directives.
