(CENTRAL HURON, ON)- On December 12, 2011 at approximately 12:30 a.m. Huron County OPP officers were dispatched to patrol for a possible impaired driver causing a traffic hazard on Huron Road. Officers located the westbound Protege on Huron Road, west of Seaforth. An officer immediately tried to stop the car however the driver continued to drive in an unsafe manner for nearly 5 kilometres before stopping.
Upon speaking with the male driver, the officer determined the driver was impaired by alcohol. He was subsequently arrested and transported to the Walkerton OPP detachment to meet with a qualified Intoxilizer Technician.
The driver refused to comply with the demand to provide samples of his breath.
Also, during a search of the vehicle incident to arrest officers seized a quantity of illegal cigarettes.
As a result of the investigation, Joshua SCOTT (34) of Central Elgin, ON has been charged with Impaired Driving contrary to section 253(1)(a) Criminal Code of Canada, Fail to Provide Breath Sample Upon Demand contrary to section 254(5) Criminal Code of Canada, Dangerous Operation contrary to section 249(1)(a) Criminal Code of Canada, Flight from Police Officer contrary to section 249.1(1) Criminal Code of Canada and Possess Illegal Cigarettes contrary to section 29(1) Tobacco Tax Act. He will answer to the charges in the Ontario Court of Justice – Goderich on February 6, 2012. The motor vehicle was impounded for 7 days.
