Load securement information initiative

On August 13, 2016 at 10:13 a.m., the Guelph Police received a report of a car pulling a trailer dropping pieces of wood onto the roadway as it travelled southbound on Victoria Road. The involved motor vehicle was located a short time later at public drop-off area of the City of Guelph Waste Resource Innovation Center on Dunlop Drive. As officers were speaking to the involved motorist, it was noticed that a significant number of citizens were arriving at the site with insecure loads.

City of Guelph staff made officers aware of a recently published information handout that explained load securement responsibilities and tips. These handouts were prepared for staff to handout to motorists at the location.

Between the hours of 11:30 a.m. and 1:00 p.m. members of the Guelph Police stationed themselves at the entrances to the public drop-off areas and spoke to motorists arriving with insecure loads. Individual load securement issues were pointed out and each driver was given a caution and an information handout.

It became clear during these contacts that load securement requirements were not understood by many drivers.

Section 111(2) of the Highway Traffic Act details load securement requirements as follows:

No person shall operate or permit to be operated upon a highway a motor vehicle that carries a load or draws a vehicle that carries a load (i.e. trailer)unless the load is loaded, bound, secured, contained, or covered so that no portion of the load may become dislodged, or fall, leak, spill, or blow from the vehicle.

The penalty for not complying with this section of the Highway Traffic Act is $85.00 (before victim surcharge) for non-commercial vehicles and $310.00 (before victim surcharge) for commercial motor vehicles.

It became apparent during this initiative drivers believed that simply having an item loaded in such a way that it didn’t fall was sufficient securement.

The legal requirements also include that items be loaded in such a way that they don’t become dislodged. This is an important element in the event that the motor vehicle or trailer is involved in a collision. Such an event usually results in the contents becoming projectiles and endangering other motorists, pedestrians and even the occupants of the transporting vehicle.

While this weekend’s initiative was focused on the Dunlop Drive area, all motorists transporting goods (both commercial and non-commercial) are required to be familiar with their responsibilities associated to load securement.
