(MUNICIPALITY OF NORTH PERTH, ON) Shortly after 10:30 a.m. on Wednesday February 09, 2011, Perth County OPP officers in Listowel received a call about an older male who was smoking in a vehicle with young children.
Police located the vehicle on Mitchell Road South in Listowel and observed an older male and female with 3 young children in a mini van. The male driver was spoken to and fresh odour of tobacco smoke was detected in the vehicle. The 56 year old driver from Palmerston admitted to smoking while having his wife and 3 grandchildren in the vehicle. His grandchildren were all under the age of 16, therefore the man was charged under the Smoke Free Ontario Act for smoking tobacco in a motor vehicle while a person under the age of16 is present in the vehicle. (The fine for this offence is $125 plus a $25 victims of crime surcharge).
