Assault

On Saturday the 9th of August, 2014, at approximately 1925hrs, a 44year old male entered the basement unit of Innisfill Street rooming house, unannounced and in an intoxicated state.

Immediately after the accused entered their apartment, the victim requested that he leave at which point words were exchange and a brief struggle ensued in an effort to remove the accused from the unit.

Approximately 30 minutes later, the accused girlfriend, began banging on victim’s apartment door, demanding the return of the accused phone.

The victim then exited the apartment/residence and into the parking lot where words were exchanged with the female. At that time, in an unprovoked attack, the accused swung a shovel towards the victim who managed to block the initial strike with his arm, causing a long abrasion to his left forearm. The accused then struck the victim towards the back of the left side of his scull causing him to fall to the ground and lose consciousness. The accused then continued to strike the victim in the head using the shovel two additional times.

As a result of the assault, the victim sustained two significant wounds to his face and scull resulting in 4-5 stitches above his right eye and 8 stables to the left side of his skull. He was transported was to the Royal Victoria Regional Health Center, by ambulance where he received medical treatment for his injuries.

A short time later, the accused returned to the scene where he was arrested by police and subsequently release on a promise to appear with a future court date and undertaking with numerous release conditions. The accused was charged with assault with a weapon and assault cause bodily harm.
