15 Year Old Arrested In Listowel For Breaking Curfew

(MUNICIPALITY OF NORTH PERTH, ON) – On Wednesday April 01, 2015, shortly after 2:30 a.m., a Perth County Ontario Provincial Police (OPP) officer on general patrol in Listowel, observed two youths walking along Elma St. at the west end of town. One of the youths was found to be 15 years of age and could therefore be apprehended under the Child and Family Services Act.

(The Child and Family Services Act states; that a police officer can apprehend children under the age of 16 that are found in a public place, or in a place of public entertainment between midnight and 6 a.m.)

A further check revealed that the 15 year old female, a resident of the Municipality of North Perth was bound by an existing Youth Court Probation Order. This order placed the youth on a court instituted curfew.

The youth was arrested and transported to the North Perth OPP Detachment in Listowel where the youth was lodged. The youth’s mother was contacted and around 3:30 a.m. the youth was released into mom’s custody by way of a Promise to Appear.

The youth now has to appear at the Ontario Court of Justice in Listowel on April 22, 2015, for a scheduled Youth Court appearance. There she will have to answer to the charge of; “fail to comply with Probation Order”, contrary to the Criminal Code of Canada.

Parents are reminded that the responsibility lies on them to know where their children are at all times. This is especially true between the hours of midnight and 6 a.m. when the provincial curfew is in effect. “No parent likes to get a phone call from the police at 3 o’clock in the morning, telling them to pick up their child from the police station”.
