Gasoline powered bicycle struck by car

On October 1, 2014 at 4:00 p.m., The Guelph Police went to Westwood Road and Silvercreek Parkway for a collision. It is alleged that a 2002 Chevrolet Cavalier was travelling northbound on Silvercreek approaching Westwood Road. Concurrently a homemade motorcycle (a bicycle with a gasoline engine affixed) was travelling eastbound on Westwood Road. The homemade motorcycle failed to stop at the stop sign at Silvercreek and was struck by the Cavalier.

The driver of the homemade motorcycle was not injured but was charged with a number of offences.

The gasoline engine kits for bicycles cause these to meet the definition of a motorcycle pursuant to the Highway Traffic Act. This means the former bicycle (now homemade motorcycle) must be licenced as a motorcycle and insured, and the driver must have a class M driver’s licence and wear a motorcycle helmet.

However, this type of homemade motorcycle will not meet the Transport Canada vehicle requirements – for safety (including lighting, brake systems, etc.). In reality this means this type of vehicle can never be licenced for use on a highway, and therefore can never be insured as a motor vehicle
